Illinois Child Custody Attorney
One of the most difficult issues in the divorce process is custody of the children. There are two different aspects of a custody determination: Legal custody and Parenting schedule. Legal custody determines which parent makes the decisions affecting the well being of the children and the parenting schedule dictates the time the children will spend with each parent.
Illinois Custody Options:
With regard to legal custody, there are two options in the State of Illinois:
A. Joint custody awarded to both parties with one parent named as the residential parent;
B. Sole custody to one parent.
In a joint custody arrangement, the parents make the major decisions regarding their children TOGETHER. Major decisions are defined as decisions about their schooling, religious upbringing, and medical care. In order for parents to be candidates for joint custody, there must be the ability to cooperate with each other when it comes to decisions regarding the children. After the divorce, if the parents disagree on a major decision, they must attend mediation in an attempt to resolve the issue prior to filing a petition in Court for a final determination. In contrast, in a sole custody arrangement, the parent named as sole custodian makes all the major decisions regarding the children.

With regard to a parenting schedule, typically one parent will maintain the primary residence for the children subject to the defined parenting time for the other parent. That parenting schedule can vary according the age of the child, the distance between the parents' residences, work schedules and the like. The time the children spend with each parent can be a schedule works for your particular family and is in the best interest of the children.
Perhaps most important, if you as parents, can maintain a business-like relationship with each other, the level of animosity will decrease and the level of cooperation increase, and the business of raising your children will be a success.
